Case Studies
A mid-sized trading company received a customs audit notice relating to the classification of electronic components imported from multiple suppliers. Classification disputes had potential duty and penalty implications. The client needed a structured legal response within a defined timeframe.
Firmavow reviewed all relevant import documentation, prepared a detailed position paper on the classification basis used, and identified the most defensible technical and regulatory arguments. The paper was submitted to the customs authority alongside supporting documentation within the required period.
The customs authority accepted the position paper without escalation to the Tribunal. The client's classification was upheld on the majority of items, with a minor adjustment on one product line. Timeline: four weeks from engagement letter to resolution. The client received a regulatory briefing as part of the engagement to inform future classification decisions.
A family-owned heritage property within Melaka's historic zone sought to convert from a residential premises to a licensed boutique hotel. The licensing requirements under the Tourism Industry Act were unfamiliar to the owners, who also needed to coordinate with the state planning authority on the change of use application.
Firmavow carried out an initial compliance review to identify all applicable licensing requirements. The team prepared the hotel license application, supported the change of use process with relevant documentation, and liaised with the Melaka state tourism office on the submission timeline and conditions.
The hotel license was obtained within six weeks of the engagement commencing. Two conditions were imposed by the tourism authority and Firmavow advised the client on how to satisfy these within the stated period. The property opened on schedule. The client subsequently returned for advisory on tour package registration as the business expanded.
Two food distribution companies with overlapping geographic coverage had agreed in principle to formalise their collaboration but had reached an impasse on profit-sharing and exit arrangements. The lack of a written agreement was creating operational uncertainty, and the informal arrangement had already led to one dispute over cost allocation.
Firmavow facilitated a structured discussion session with both parties to clarify commercial positions on the outstanding issues. The advisor identified the source of the impasse and helped the parties reach a workable position on profit-sharing before drafting began. The agreement was then prepared with clear definitions and an exit mechanism both parties agreed was fair.
The agreement was executed within three weeks of the initial structuring session. Both parties expressed satisfaction with the process and the clarity of the final document. The cost allocation dispute was resolved as part of the structuring discussion and documented in an agreed schedule to the agreement. No further disputes have arisen since the agreement was put in place.
